We process your personal data in the following situations:
– when you visit our website (fiabmachines.com) or our company's fanpage on the social media platforms Facebook or YouTube, in order to ensure the proper display of content on our website, control and analyze traffic on the website and fanpage, and respond to messages sent to us via the contact form or Messenger. In this case, the legal basis for processing personal data is the legitimate interest of the controller (Art. 6(1)(f) GDPR);
– when we conduct marketing activities on our website and through social media, or send marketing information to our customers or contact them by phone for marketing purposes. In such cases, the legal basis for processing personal data is the pursuit of our legitimate interests as the controller (Art. 6(1)(f) GDPR);
– if you have given consent, e.g., to receive our newsletter or for commercial-marketing contact by email and phone, we process your personal data within the scope of the consent granted for the given type of contact, based on the legitimate interest of the controller (Art. 6(1)(f) GDPR).
– when you send us an inquiry, e.g., in connection with interest in our commercial offer, in order to respond to it. In such a situation, the legal basis for processing personal data is the necessity to take steps before entering into a contract, if the person whose data is concerned contacts us (Art. 6(1)(b) GDPR), or legitimate interest if the contact is initiated by a person representing another entity (Art. 6(1)(f) GDPR);
– if you are planning or have already entered into a contract with us – for the proper performance of this contract (Art. 6(1)(b) GDPR);
– for the purposes of fulfilling our obligations that we are required to fulfill on the basis of relevant provisions specifying these obligations, e.g., tax and accounting regulations, i.e., for the purpose of fulfilling our legal obligations (Art. 6(1)(c) GDPR);
– in connection with the exercise of other legitimate interests as the controller or third parties, such as pursuing or defending against claims, i.e., based on the legitimate interest of the controller (Art. 6(1)(f) GDPR).
Recipients of your data may be:
– entities to which we have entrusted the processing of personal data on our behalf, providing services for us, in particular accounting, IT, legal, technical services, or employment agencies,
– entities or authorities authorized under legal provisions, with the reservation that public authorities that may receive personal data within specific proceedings are not considered recipients within the meaning of GDPR; In addition, with respect to data processed through our fanpage or our website, the following entities responsible for maintaining and technically supporting the website, the entity monitoring the number of visitors, and the social media platform Facebook will be recipients of data:
– Meta Platforms Inc with its registered office in California, USA, and Meta Ireland Ltd – are the entities responsible for fanpage activities on Facebook. Meta Platforms Inc has certified its participation in the EU-US Data Privacy Framework. Meta Ireland relies on the EU-US Data Privacy Framework and the European Commission's adequacy decision for transfers of European data to Meta Platforms, Inc. in the USA, in accordance with Meta's Data Privacy Framework Statement. Facebook Ireland Ltd is an entity under Irish law and therefore applies EU rules on the processing of personal data,
– Google LLC with its registered office in California, USA, and Google Ireland Ltd – entities responsible for the operation of the YouTube fanpage. Google LLC processes data taking into account the European Commission's adequacy decision for transfers of European data to Google companies in the USA, in accordance with the statement available at https://policies.google.com/privacy/frameworks?hl=pl. Google Ireland Ltd is an entity under Irish law and therefore applies EU rules on the processing of personal data.
Your personal data will be stored:
– in the case of processing data on the basis of consent – until the consent is withdrawn;
– in the case of processing data for the purpose of presenting an offer – for the duration of contract negotiations and until the end of the calendar year following the year in which you last contacted us regarding its conclusion;
– in the case of processing data for the purpose of contract performance – until the expiry of all limitation periods arising from this contract;
– in the case of processing data for the purpose of fulfilling legal obligations – the period of data processing is determined by the relevant provisions;
– in the case of processing data on the basis of the legitimate interest of the data controller – until the cessation of this interest (e.g., expiry of claims), or until an effective objection is raised against further processing of data by the data subject.
In connection with the processing of personal data, you have the following rights:
– right of access to your personal data – you may request from us a number of pieces of information about how we process your personal data, including: why we process personal data, what categories of personal data we process, to whom we transfer personal data, how long we store personal data or what criteria are used to determine this period, from what source we obtained your personal data (if we did not receive it directly from you), whether data processing includes automated decision-making (so-called profiling). You may also request from us a copy of your personal data that we process. This may, but does not have to, involve fees equal to the costs of handling your request. If charging fees is necessary, we will inform you of this without delay, before fulfilling the request.
– right to rectification of personal data – if your personal data does not correspond to the actual state of affairs, you may ask us to correct it. In case you wish to correct data, please provide a document confirming the changes. We also ask you to inform us about changes to the data that we have been processing so far, in order to ensure their accuracy and reliability.
– right to erasure of personal data and to be forgotten – if you believe that your personal data is being processed by us unlawfully, longer than necessary, or without reason, you may ask us to delete it.
– right to restriction of processing of personal data – you may ask us to restrict the processing of your personal data exclusively to their storage or the performance of actions agreed with you, if in your opinion we have incorrect data or are processing it without basis.
– right to object to the processing of personal data – you have the right to object to us processing your data for the purpose of direct marketing. Exercising this right will result in us ceasing to process your data for this purpose. In addition, you may object to the processing of your personal data for other purposes than direct marketing. In such a case, please indicate the particular situation that, in your opinion, justifies us ceasing the processing subject to the objection. As a result of the objection raised, we will cease to process your data for these purposes, unless the grounds for our processing of your personal data prove to be overriding in relation to your rights, or your data proves to be necessary for us to establish, pursue, or defend claims.
– right to data portability – you are entitled to receive from us, in a structured, commonly used, and machine-readable format (e.g., on a computer), your personal data that you have provided to us, provided that the processing is based on consent (Art. 6(1)(a) and Art. 9(2)(a) GDPR), or a contract (Art. 6(1)(b) GDPR), and the processing is carried out in an automated manner. Within the scope of this right, you may also instruct us to send this data directly to another entity.
– right to withdraw consent to the processing of personal data – if we process your data on the basis of your consent to the processing of personal data, you may withdraw this consent at any time. Please remember, however, that the withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
– right to lodge a complaint with a supervisory authority – you are entitled to lodge a complaint regarding the processing of your personal data with the President of the Office for Personal Data Protection (Prezes Urzędu Ochrony Danych Osobowych).
Providing data is voluntary; however, it is necessary if you wish to enter into a contract with us or receive an offer. Providing data for the purpose of processing data on the basis of consent is completely voluntary, and you have the right to withdraw consent at any time. Withdrawal of consent will not affect the lawfulness of processing carried out so far.
As a rule, we do not carry out automated data processing in a manner that would result in any decisions being made about you or otherwise affect your situation. Nevertheless, entities that receive your personal data in connection with entering their website may use it to display similar content to you, tailored to what you have searched for (profiling). This applies in particular to the services of Google and Facebook.
When you visit our websites, information in the form of a cookie may be stored on your computer. Cookies serve to automatically recognize your computer during a subsequent visit to our websites. Cookies allow, among other things, the adaptation of your preferences regarding the visibility of websites and their functionality to your needs. If you do not wish your computer to be recognized by us, you can change the settings of your web browser on your computer in such a way that it deletes cookies from the hard drive, blocks them, or warns before saving them. However, this may result in some functions on our websites being unavailable to you. In addition to our own cookies (i.e., those placed directly by us on the websites), there are also external cookies placed by external entities such as Facebook and Google, whose website components have been called on our website.
